Digital Tachograph: Implementation of Commission Regulation (EU) No 1266/2009
According to the letter of 19 July 2010 by the European Commission (DG MOVE, Directorate D Inland Transport) addressed to the Joint Research Centre (JRC) of the European Commission, field tests with non type approved equipment, using test keys instead of official and real keys, are feasible without threats to the overall security of the Digital Tachograph system and are therefore planned under the exemption of Article 3(g) of Regulation 561/2006.

The form “Digital Tachograph - Implementation of Commission Regulation (EU) No 1266/2009 - Field Tests: Terms of Reference” defines the procedure applicable to field tests with non type approved digital tachographs. It must be signed by the representative of the parties involved in a field test, typically an industry entity (manufacturers of vehicle units and/or motion sensors or vehicle manufacturers) and a transport company, committing themselves to respect the rules and principles of the procedure described in the document.

Three distinct documents will constitute the written reference for these field tests:

1. “Field Test Terms of Reference”: Agreement – Procedure – General Conditions, to be signed by the partners.

2. Annex I: the “Information Form”, to be compiled by the applicants. This document has to be accompanied by the “Terms of Reference” signed by the Field Test Operator and the transport undertaking.

3. Annex II: the “Field Test Passport”, to be compiled by the applicants. This document proves the participation to field tests; it must be kept in the vehicle and be presented in case of control.

CORTE Card and Enforcement Working Groups meeting
From 30 March to 1 April 2011, CORTE Card and Enforcement Working Groups will meet in Brussels for the second time to follow up on the work carried out by their predecessors – MIDT CINC and ENC working groups.

CORTE has been working for years on the digital tachograph card used by drivers of commercial vehicles. In June 2010, it was agreed that the implementation of the digital tachograph has reached a stage of development that calls for a reshape of its project, structure and content (the MIDT, Monitoring the Implementation of the Digital Tachograph). The implementation of the digital tachograph system at EU level is quasi complete and the MIDT should therefore be adapted. In consequence the MIDT CINC and ENC Committees are replaced respectively by the CORTE Card Working Group and the Enforcement Working Group.

The new CORTE Working Groups in part pursue the work carried out by the MIDT ENC on Regulations (EEC) n°3821/85 and (EC) n° 561/2006. They will also open up to new issues that are indirectly linked, or not linked, to the digital tachograph such as the training of professional drivers (Directive 2003/59/EC), driving licenses, access to the profession, etc.
 
CORTE attends the special UNECE meeting dedicated to the AETR
On 4 March 2011, CORTE will be represented at the Special Meeting of Contracting Parties to the European Agreement Concerning the Work of Crews of Vehicles Engaged in International Road Transport (AETR) concerning the relationship between AETR and EU laws (article 22bis and prevailing legal instrument), to be held in Geneva (Switzerland).

At the session of UNECE Working Party on Road Transport held on 29 September – 1 October 2010, discussions took place about amending or deleting AETR article 22bis. On the one hand, the amendment discussion has originated from the legitimate need of non-EU Contracting Parties to be involved in the elaboration of control device technical requirements. On the other hand, there appears to be no formal possibility of such involvement within the procedures of the European Commission.

To work on this issue, the Working Party decided to create a group of experts mandated to draft a revised text for article 22bis. The group includes experts from the European Commission, Hungary, Russian Federation, Turkey and Ukraine. At this special meeting, AETR Contracting Parties are expected to prepare and discuss article 22bis amendments with a view to bridging gaps between Parties.

CORTE publishes the Consolidated version of the AETR
The Confederation of Organizations in Road Transport Enforcement (CORTE) Secretariat recently published the consolidated version of the European Agreement Concerning the Work of Crews of Vehicles Engaged in International Road Transport (AETR).

This consolidated version brings together and integrates in one single document the amendments that have been adopted since AETR’s origin (1970).

The consolidated text integrates:

-the original Agreement (E/ECE/811; E/ECE/TRANS/564);
-amendments 1-4 (E/ECE/811;E/ECE/TRANS/564/Amend.1-4) which entered into force respectively on 3 August 1983, 24 April 1992, 28 February 1995 and 27 February 2004);
-the fifth amendment (TRANS/SC.1/375/Add.1) which entered into force on 16 June 2006;
-and the sixth and latest amendment which entered into force on 20 September 2010.

Overview of the CORTE deliverables under the LTSS project
In the context of the LTSS project (Land, Transport, Safety, Security, see www.traceca-ltss.eu), CORTE experts provided a set of training sessions and study visits helping countries linked by the TRACECA program to implement the digital tachograph system.

The objective of the trainings was to address very specific issues involving CORTE experts coming from different fields of activities: card issuing, enforcement and approval of workshops. They were provided in geographical area of targeted countries.

As a complementary action, study tours, hosted by EU/EEC countries, were organised following the same methodology as the trainings (card issuing, enforcement and approval of workshops).
