Per-Arne HOLM
It is with great sadness that we inform you that Per-Arne Holm, our colleague from the Swedish Transport Agency, passed away in February. Per-Arne Holm was recognized as one of the most respected experts in the field of digital tachographs. His achievements and contributions to the MIDT-CORTE activities were numerous and always of crucial value. For many of us who had the opportunity of working with Perra, he became a friend. He was a person of great kindness and generosity. His dedication and friendship will be greatly missed.
 
New measures are confirmed by the Commission for the improvement of the digital tachograph system
On 23 January 2009 the European Commission confirmed that it has adopted a range of anti-fraud measures for the digital tachograph system and a new legislation concerning the tachograph equipment in some light vehicles.

The series of new measures include amendments to Directive 2006/22/EC which require Member States to develop dedicated equipment and software for analysing the data from the digital tachograph. Moreover, a Commission Recommendation sets out best practice guidelines for national control authorities when carrying out checks of vehicles and the recording equipment, whether at the roadside, at company premises, or at workshops. These proposals should improve the methods and procedures used by control authorities in detecting and preventing the use of devices intended to defraud the tachograph system, and at the same time reduce unnecessary delays and inconvenience to law-abiding operators and drivers.

Secondly, the Commission adopted a Regulation allowing the use of a dedicated, type-approved adaptor for those light vehicles (M1 and N1 class) which technically could not be fitted with the digital tachograph equipment.

Next meetings for the SMART project and TACHOnet user group
On 8 January 2009 the European Commission announced that the next meetings for the SMART Digitac project and the TACHOnet User Group will both take place on 11 February 2009 at the premises of DG TREN.

The agendas of these meetings will be issued by the Commission in the weeks to come.

Czech Republic joined the TACHOnet system
On 12 December 2008 the European Commission announced that the Czech Republic has successfully completed the TACHOnet tests. Accordingly, the Czech system is now fully operational and Member States have the opportunity to check the issuance of their respective Tachograph cards through the Czech Cards Issuing Authority as well.

A new Tachograph manufacturer is type approved
EFKON is the fourth tachograph manufacturer in the European Union which recording equipment has been officially type approved on 24th of November 2008 and joins on the market Actia, Continental and Stoneridge.

Memorandum of Understanding between the UNECE and the JRC on root certification and interoperability
On several occasions and notably during the 102nd session of the UNECE Working Party on Road Transport of the Inland Transport Committee, representatives from non-EU AETR contracting parties expressed concerns that their countries would not be ready to implement the digital tachograph by 16th of June 2010, without receiving support from experienced countries.

Taking into consideration their concerns, a Memorandum of Understanding has been signed between the European Commission, UNECE and the EU Joint Research Center (JRC) in the framework of the 103rd session of the UNECE Working Party on Road Transport of the Inland Transport Committee, which took place in Geneva, on 29-31 October 2008.

Through this Memorandum, UNECE officially recognizes JRC as the AETR Authority for root certification and for interoperability certification for the non-EU AETR contracting parties.

Bulgaria is now connected to TACHOnet
On 11 November 2008 the European Commission announced that Bulgaria has successfully completed the TACHOnet test and has entered into the production phase. Accordingly, Member states have now the opportunity to check the issuance of their respective Tachograph cards through the Bulgarian Cards Issuing Authority as well.

Bulgaria is the 26th country connected to TACHOnet, while Andorra, the Czech Republic, Greece, Hungary and Monaco are expected to join soon the system in production as they are currently carrying out their final test phases.
 
Greece has started issuing tachograph cards
Greece has officially started issuing digital tachograph cards as from the 3rd of November 2008. The Greek CIA Information System is therefore operational and ready to process the collected applications. The functional connection to TACHOnet is, however, not yet operational but Greece expects to connect to this system in the very weeks to come.

With this achievement by the Greek Authorities, all the Member States of the European Union are now issuing digital tachograph cards.

MIDT taken over by CORTE
After a successful collaboration of the Swedish Road Administration and the European Commission DG TREN, the MIDT project officially came to its end in March 2008. Following, the administration and management of the project were handed over to the Confederation of Organisations in Road Transport Enforcement (CORTE, www.corte.be), located in Brussels. CORTE intends to continue with all project-related activities, whereas the next project meetings are scheduled on 23 and 24 June 2008 in the Slovenian town of Bled.
 
Commission addresses 8 Member States on Directive 2006/22/EC
The European Commission has sent reasoned opinions – the last step before a formal complaint to the Court of Justice – to Greece, Italy, Lithuania, Luxembourg, Portugal, Romania, Slovakia and the United Kingdom for failure to notify their national measures transposing Directive 2006/22/EC which should have been transposed into national law by 1 April 2007. The Directive sets out minimum conditions for implementing new rules in the road transport sector on driving times and rest periods and on the introduction of the digital tachograph. By failing to implement this Directive, the Member States lack the necessary legal tools to promote fair competition within the sector and improve road safety.
 
Digital tachograph implementation: Commission takes Greece to the Court of Justice
The European Commission launched a court proceeding against Greece for failure to properly introduce the digital tachograph system. Regulation 3821/85 requires that digital tachographs must be fitted into all goods vehicles and buses that come into scope of the Drivers' Hours Rules and that are registered after 1st May 2006. Greece has failed to take required measures, in particular it had not yet established its national card issuing authority and system for producing and securely distributing the tachograph cards.
